When you visit the In-Shape Fitness Website, Portal, or App to manage your In-Shape Fitness Membership account, subscribe to fitness program/class schedules, and or sign-up for our Newsletter you may choose to give us basic information: name, email address, mailing address, ZIP code, phone, and credit card numbers. This allows us to process your transactions more efficiently, and ultimately, to give you a higher caliber of customer service. This tracking data helps us understand how to make our site more available and user friendly to our customers.

In-Shape Fitness is proud to be a certified PCI DSS Compliant Service Provider. The In-Shape Fitness website uses Secure Socket Layer (SSL) and Virtual Private Network (VPN) technology to encrypt personal information such as User IDs, Passwords, and account information over the Internet. Name Removal From Our Lists At Any Time

To delete your name from the In-Shape Fitness email mailing list, simply contact us by email at consumerprivacy@inshape.com or by selecting the “unsubscribe” link at the bottom of any In-Shape Fitness email. Be sure to provide your full name, mailing address, email address, and phone number. We appreciate your patience as it may take up to four weeks to process your request from the date of receipt.

Children's Privacy Statement

In-Shape Fitness adheres to a strict privacy code regarding children and does not knowingly accept personal information from any child. If it is brought to our attention that a subscriber is underage, we will immediately remove all personal and identifiable information from our records in compliance with the Online Children's Privacy Protection Act of 1998. In addition, we will not disclose this information to any other companies.

This children's privacy statement explains our practices with respect to the online collection and use of personal information from children under the age of thirteen and provides important information regarding their rights under federal law with respect to such information.

• In-Shape Fitness’s website is not directed to children under the age of thirteen and we do NOT knowingly collect personally identifiable information from children under the age of thirteen as part of our website. If we become aware that we have inadvertently received personally identifiable information from a user under the age of thirteen as part of our site, we will delete such information from our records. If we change our practices in the future, we will obtain prior, verifiable parental consent before collecting any personally identifiable information from children under the age of thirteen.
• We do NOT knowingly allow children under the age of thirteen to publicly post or otherwise distribute personally identifiable contact information through our website.

Employee Conduct

The In-Shape Fitness Privacy Guidelines express our absolute commitment to integrity, our related corporate values and ethical standards and the associated business conduct we expect from all our employees. The guidelines include very specific guidelines concerning the safeguarding of confidential information, which includes customer information. In general, these guidelines limit employee access to confidential information, and limit the use and disclosure of such information to specifically authorized processes and transactions. If it is determined that employees have violated the guidelines, corrective action may be taken, including immediate dismissal.

Security

In-Shape Fitness makes reasonable efforts to maintain the security of your personal information in order to prevent unauthorized access to it through the use of technology and internal procedures.

Information Disclosed If Required By Law

If required by law, In-Shape Fitness may provide any and all information we have about you to law enforcement or other government agencies, pursuant to a subpoena, warrant, or other order by a court of competent jurisdiction. In all cases, we will require written documentation of the request, proof of the identity of the law enforcement official making the request, and we will take reasonable steps to authenticate the validity of the request. Any law enforcement or government agency request submitted with less than a court-issued order will be evaluated on a case-by-case basis according to the need and urgency, as well as the particular law enforcement agency making the request.

Privacy Policy Updates

Efforts to bring new services, ideas and partners to benefit our customers may make it necessary for us to create a new Privacy Policy. If this occurs, we will post the new policy on our website. Once posted, the new policy will go into effect immediately, replacing any previously stated policy.

In-Shape Fitness may also amend our current Privacy Policy at any time. If we amend this Privacy Policy to permit material changes in the way we collect, use, and/or share your personal information, we will notify you of such amendment by sending you an email at the last email address that you provided us, and/or by prominently posting notice of such amendment on the websites covered by this Privacy Policy. The effective date of this In-Shape Fitness General Privacy Policy is June 30, 2023. It replaces all prior privacy policies issued by In-Shape Fitness. We reserve the right to change the In-Shape Fitness Privacy Policy at any time. Any changes to our Privacy Policy will be reflected in the updated version displayed at our corresponding website.

By submitting information, I authorize In-Shape Fitness Family Fitness to deliver to me, at the telephone, cellphone, or email address(es) provided, telemarketing calls, emails and texts and informational calls, emails, and texts. How We Will Verify That it is Really You Submitting the Request

If you are a California resident, when you submit a Right to Know, Right to Access, Right to Delete, or Right to Correct request through one of the methods provided above, we will ask you to provide some information in order to verify your identity and respond to your request. Specifically, we will ask you to verify information that can be used to link your identity to particular records in our possession, which depends on the nature of your relationship and interaction with us. For example, we may need you to provide your name, email, phone number, IP address, browser ID, amount of your last purchase with the business, and/or date of your last transaction with the business.

 

Responding to Your Right to Know, Right to Access, Right to Delete, and Right to Correct Requests

Upon receiving a verifiable request from a California resident, we will confirm receipt of the request no later than 10 business days after receiving it. We endeavor to respond to a verifiable request within forty-five (45) calendar days of its receipt. If we require more time (up to an additional 45 calendar days, or 90 calendar days total from the date we receive your request), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. The response we provide will also explain the reasons we cannot comply with a request, if applicable. 

We do not charge a fee to process or respond to your verifiable request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

For a request to correct inaccurate personal information, we will accept, review, and consider any documentation that you provide, and we may require that you provide documentation to rebut our own documentation that the personal information is accurate. You should make a good-faith effort to provide us with all necessarily information at the time that you make the request to correct. We may deny a request to correct if we have a good-faith, reasonable, and documented belief that a request to correct is fraudulent or abusive. If You Have an Authorized Agent:
